1. GENERAL TERMS OF USE

1.1. These terms of use determine the procedure for using the online shop SaintKey.com.

 

1.2. SiKey LLC, 40203290782, registered office in Riga, Bruninieku str.12-2, LV-1001, hereinafter –  SiKey LLC or Seller, ensures SaintKey.com content and provides services with following the terms.

 

1.3. The User/Buyer is a natural person with the legal capacity to act that makes purchases in SaintKey.com or uses other SaintKey.com services. Persons with the ages of between 14 and 18 use SaintKey.com services only with the given permission of a parents or guardian, unless they have their own legal revenue sources.

 

1.4. If the User/Buyer purchases the goods offered by SaintKey.com, these terms and conditions are considered to be a legally binding document that defines the rights and obligations of the parties in connection with the purchase, payment of goods, and the conditions for the delivery and return.

 

1.5. If the User/Buyer makes purchases from SaintKey.com, it is considered that the User/Buyer has read SaintKey.com online shop terms and conditions and completely agrees to them. By agreeing to the terms and conditions, the User/Buyer confirms that he or she has the right to register and purchase goods in the online shop SaintKey.com in according to these terms.

 

1.6. If the User/Buyer attempts in any way to make harm to SaintKey.com operation, stability, security, or, otherwise, does not comply with these terms of use, SiKey LLC keeps the right to cancel User/Buyer registration or otherwise restrict the User/Buyer’ access to the SaintKey.com online store.

 

1.7. SiKey LLC reserves the right to unilaterally amend and supplement these terms and conditions at any time. When the User/Buyer makes purchases from SaintKey.com, the latest Terms and conditions applied to this purchase, therefore the User/Buyer must check the latest Terms and conditions before allocating each order.

 

1.8. SiKey LLC keeps the right to change the price of the goods or to determine the special price or discounts for the goods. The goods are sold to the User/Buyer according to the prices that are in force at the time of purchase.

 

2. PROTECTION OF PERSONAL DATA

2.1. Both registered and unregistered Users/Buyers are allowed to proceed with shopping at SaintKey.com. In order to register on SaintKey.com, the User/Buyer requested to provide the following obligatory information: name, surname, e-mail address, and a password. By registering on SaintKey.com online shop, the User/Buyer (real human) shall be aware that her/his personal data will be processed according to the SiKey LLC Privacy Policy. To be able to enter its own profile on SaintKey.com, the User/Buyer must submit previously registered e-mail and password in the appropriate fields.

 

2.2. When making a purchase on SaintKey.com, the User/Buyer should enter correct information for delivery and payment: name, surname, complete delivery address, contact telephone number, and e-mail address.

 

2.3. The User/Buyer is solely responsible for the accuracy of the data specified in the registration form, as well as for the accuracy of the data provided when making a purchase from SaintKey.com. If the User/Buyer has provided inaccurate or incorrect data in SaintKey.com registration form or when making a purchase, SiKey LLC is not responsible for the incorrectness of the data and possible consequences with order proceeding and delivery, as well as keep the right to claim the compensation for any losses due to this reason. The has the right to correct, delete or add personal data in his or her SaintKey.com personal profile at any time, or request SaintKey.com team to correct, delete, or add additional data as and accordance to SiKey LLC Privacy Policy.

 

2.4. When registering on SaintKey.com, the User/Buyer obtains individual registration data (username and password). The User/Buyer is responsible to keep in secure place and not to disclose its registration data to a third party. If the registration data is used by a third party, she or he is considered as initial User/Buyer. If the User/Buyer loses registration data, or the User/Buyer suspects that his/her registration data may have been illegally obtained by a third party, the User/Buyer must immediately inform SiKey LLC team via SaintKey.com “Contacts” section published contacts information.

 

2.5. By agreeing to these Terms and Conditions as well as the SiKey LLC Privacy Policy, User/Buyer confirms that all notifications required for order processing, payment and delivery will be sent to User/Buyer specified e-mail address.

 

2.6. By this SiKey LLC confirms that User/Buyer data will be used only for product purchase processing and direct marketing purposes. SiKey LLC shell transfer personal data necessary for payment execution only to authorized financial Partner that provides payment solutions for SaintKey.com online shop transactions and that follows strict Personal data Privacy Policy controlled by the Latvian and EU legislation.

 

2.7. SiKey LLC undertakes responsibility to ensure the confidentiality and not disclosure of Personal Data provided by the User/Buyer to the third parties, excluding SiKey LLC Partners who provide the delivery of goods to the User/Buyer, services related to the execution of the orders, as well as in the cases specified in state institutions’ regulatory requirements.

 

2.8. At the time of delivery of the goods, the recipient of the goods may be asked to present a valid identity document to check the identity of the person.

 

3. A PURCHASE – SALE /DISTANCE AGREEMENT

3.1. The contract on product purchase between SiKey LLC and the User/Buyer is considered to be concluded from the moment when the User/Buyer has created a shopping cart after selecting the item(s) and confirming “pay for the purchase” step. The User/Buyer is obliged to pay for the goods in accordance to the procedure and within the time limits given in the Terms of Use.

  

3.2. Purchase agreements are registered and stored in SaintKey.com database.

 

3.3. SiKey LLC agrees to deliver ordered and paid goods to the User/Buyer specified address, based on the conditions set out in section 5 of the Terms of Use.

 

3.4. If SiKey LLC fails to contact the User-Buyer within 5 (five) working days from the order allocation, the order to be cancelled automatically. In this case SiKey LLC will make a refund to the User/Buyer only for the cost of purchased Product, delivery fee will not be refunded.

 

3.5. In cases if some products are ordered at SaintKey.com, but due to technical or other reason become unavailable for delivery, SiKey LLC can provide substitution by the similar products. If the User/Buyer do not accept this substitution for unavailable products SiKey LLC confirms return of the paid amount for this order as soon as it possible, but not later than 30 (thirty) calendar days from the day of its purchase.

 

4. PRICE OF GOODS AND PAYMENT PROCEDURE

4.1. Prices of goods and services on SaintKey.com are indicated in EUR currency and include Latvian value-added tax – 21%. The delivery fee (if any) to be calculated separately in accordance to SaintKey.com shipping charges.

 

4.2. All payments on SaintKey.com are made in the Euro currency.

 

4.3. The User/Buyer can pay for the goods in the following ways:

4.3.1. worldwide online via incorporated Partner payment system on SaintKey.com;

4.3.2. within Latvia online with the Bank transfer from the following banks – Swedbank, SEB, Luminor, Citadele.

4.3.3. within Latvia in cash - if the order to be received at the SiKey LLC show room.

 

5. ORDERING GOODS

5.1. To make a purchase of the goods, the User/Buyer selects the required product on SaintKey.com web store and adds it to the shopping cart by clicking on the “Add to cart” button.

 

5.2. To allocate an order, the User/Buyer should perform the following actions:

5.2.1 Select required products by adding them to the “Shopping Cart”, then check all added items by clicking “View Shopping Cart” button. The User/Buyer can review all selected items, add additional or remove not required ones and then move to the checkout procedure by clicking “Checkout” button.

5.2.2. After entering the requested data and checking the correctness of the data, the User/Buyer confirms the order by pressing the “Place order” button. After this step, the order is approved and transferred to SaintKey.com for further processing and delivery.

5.2.3. The User/Buyer pays for the Order online via SaintKey.com incorporated payment system or via internet bank. If payment is made via Internet bank, - the Bank approval statement should be sent to SaintKey.com.

5.2.4. After the payment process is completed SaintKey.com sends the purchase approval to the e-mail address specified by the User/Buyer.

 

5.3. During order allocating process User/Buyer must provide an accurate personal data, required to proceed with the payment and delivery, as well as valid contact information. In case of inaccurate data, the Order may not be delivered.

5.3.1. SaintKey.com is not responsible for any cases where delivery is not possible due to incomplete delivery address or personal data provided by the User/Buyer.

5.3.2. SaintKey.com has the right to refuse order processing or delivery in case of any doubts on accuracy of User/Buyer submitted information or non-compliance with the generally accepted principles.

 

6. USING COUPONS

6.1. Discount coupons can be obtained at SaintKey.com web store, in official SiKey LLC social media pages in major social platforms (Facebook, Instagram, ...), received from our official e-mail box or via SMS, as well obtained during other official promotional campaigns organised by SiKey LLC.

 

6.2. The code listed in the discount coupon can only be used once and only while shopping at SaintKey.com web store.

 

6.3. The SiKey LLC issued coupons can provide a percentage discount of the order or give a certain amount off to the order Sum;

 

6.4. Discounts from the two or more coupons can not be combined together. Only 1 (one) coupon can be used at a time.

 

6.5. Discount coupons can not be exchanged for money or other coupons.

 

6.6. It is forbidden to sell or share discount coupons.

 

6.7. Discount coupons are valid until the specified date only. All expired discount coupons are not valid for use on SaintKey.com web store, validity terms can not be extended, its value can not be compensated.

 

6.8. The coupon holder is responsible for non-disclosure of the coupon information.

 

6.9. Already used discount coupons are not refundable.

 

6.10. Invalid, lost, or otherwise damaged (corrupted or illegible coupon code), discount coupons are not refunded and its expiry date can not be extended.

 

7. DELIVERY OF GOODS

7.1. The User/buyer when selecting the delivery method should provide the exact delivery address or selected Post station or parcel terminal.

 

7.2. The products ordered at SaintKey.com may be delivered to the User/Buyer by SiKey LLC or its authorized delivery Partner.

 

7.3. The commitment of the User/Buyer is to accept the goods that he or she have ordered from the courier.

 

7.4. The SaintKey.com always tries to ensure the ordered goods delivery as soon as possible, however due to external reasons delivery terms may vary and some delays potentially can not be excluded.

 

7.5. When choosing delivery to the parcel terminal, the order will arrive to the chosen parcel terminal within 5 working days (for internal Latvian orders) after sending the order confirmation to the User/buyer’s e-mail address. In this case the User/buyer will be informed by text message on goods delivery to the parcel terminal, providing the parcel terminal address, door code, storage period, return code. The parcel terminals are open 24/7. Usually goods are stored in the parcel terminal no more for than 7 calendar days. After that period, the goods will be returned to SaintKey.com web store. In case if ordered items were not collected from the parcel terminal within the required time the User/Buyer is obliged to reimburse the full costs associated with the return of the goods to SaintKey.com.

The User/Buyer is obliged to keep the text message with delivery details up to the end of the 14-day return period. The SaintKey.com web store User/Buyer has the right to replace or return the goods if necessary by using a return code.

 

7.6. If the User/Buyer can not be reached at the User/Buyer’s specified delivery address, SiKey LLC or its delivery Partner has the right to transfer the ordered goods to any other person at the destination address (aged 18 or older) that is currently available at the time of delivery. In this case the User/Buyer does not have the right to make SiKey LLC any claims for delivery to the non-compliant person.

 

7.7. If the delivery of goods to the User/Buyer is not possible due to the User/Buyer’s fault or User/Buyer’s depending circumstances (the User has specified the wrong address, the User is not present at the specified address, the specified address cannot be accessed, etc.), the goods will be sent back to SaintKey.com, the order cancelled automatically, no items be re-sent to the User/Buyer. SiKey LLC will provide refund to the User-Buyer only for the cost of purchased goods, delivery fee and associated costs would not be refunded.

 

7.8. After receiving of the goods, the User/Buyer or her/his representative checks the goods and signs the invoice or other acceptance document presented at the time of delivery by SiKey LLC or its delivery Partner. By signing the invoice or other acceptance documents, the User-Buyer or his representative confirms that the goods have been delivered in good condition. In case of packaging of the goods found crumpled, wet, or otherwise damaged from the outside, the User/Buyer must indicate it (write a comment) in the acceptance documents or in a separate defectation act. The User/Buyer must do so in the presence of a SiKey LLC delivery agent or its delivery Partner’ courier. SiKey LLC is not responsible for any goods deficiencies that were discovered at the time of delivery but were not indicated in the delivery acceptance document or indicated after delivery agent or courier left.

 

7.9. All ordered items can also be picked up directly from the show room during its working hours. In this case payment for the order can be done in the Show room by card or cash.

 

 

8. QUALITY OF GOODS

8.1. The characteristics of all goods sold on SaintKey.com indicated next to each item.

 

8.2. SiKey LLC goods are covered by the guarantee specified in the relevant legal acts.

 

8.3. In the case when the product does not comply with the terms of the Contract, the User/Buyer can request SiKey LLC to perform one of the following actions:

8.3.1. solve the issue with the product to comply with the terms of the Contract;

8.3.2. exchange the product for another one;

8.3.3. make a discount or reduce the price of the product;

8.3.4. cancel the Contract and refund to the consumer the amount of money paid for particular product or complete order. By reducing the price, cancelling of the contract, calculating of the refund, SiKey LLC may take into account the depreciation of the product or the benefit that the User/Buyer has gained from using it.

 

8.4. In case of insignificant non-compliance of the product (does not significantly reduce its quality, characteristics, performance of the basic functions, has no significant visual defects), i.e. cannot significantly affect the User/Buyer’s ability to use the product, the User/Buyer can not request SiKey LLC to cancel the contract and refund already paid amount of money.

 

8.5. All objections and requests for non-compliance of the product with the terms of the contract can be send via e-mail to the contact information given on SaintKey.com or by post to SiKey LLC legal address: Riga, Bruninieku str.12-2, LV-1001, or via European centralized Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=EN)

9. THE RIGHT OF WITHDRAWAL AND RETURN POLICY

9.1. The User/Buyer has the rights to withdraw their order within 14 days after the Item has been delivered by sending a letter of withdrawal to SiKey LLC. The form of Letter of Withdrawal can be sent to the User/Buyer by an e-mail on request.

 

9.2. It is mandatory to indicate the User/Buyer’s bank account to which she or he wishes to receive back the amount paid for the purchased goods. SiKey LLC notifies the User-Buyer by an e-mail on the fact of receiving the application regarding to the right of withdrawal.

 

9.3. It is considered that the User/Buyer has complied with the term of the right of withdrawal (14 days) if the User sends the application for the exercise of the right of withdrawal to SiKey LLC before the expiry of the term of the right of withdrawal. In case of any disputes, the User/Buyer is obliged to prove the exercise of the right of withdrawal.

 

9.4. After sending the application for the exercise of the right of withdrawal, the User/Buyer sends or delivers the product back to SiKey LLC to its legal address: Riga, Bruninieku str.12-2, LV-1001 or to the Show room. This deadline is considered to be met if the User/Buyer sends or returns the goods to SiKey LLC before the expiry of the 14-day term since the delivery date to the User/Buyer.

 

9.5. SiKey LLC will provide refund of the money paid for the product to the User/Buyer without undue delay, but no later than within 14 days from the date of receipt of the User/Buyer’s application for the exercise of the right of withdrawal. SiKey LLC refunds the amount by transferring it to the bank account specified in the User/Buyer’s withdrawal form or, if it is not specified, to the account from which payment for the product was received originally.

 

9.6. SiKey LLC reserves the right to withhold the refund of the amount paid for the purchase of goods to the User/Buyer until SiKey LLC has received the returned product from the User/Buyer.

 

9.7. The direct cost of returning the product is paid by the User/Buyer. If due to its nature, the goods cannot be returned by post or parcel post, the consumer (User/Buyer) shall bear all costs associated with the return of the goods.

 

9.8. The User/Buyer may exercise the right of withdrawal under the following conditions:

9.8.1. the returned product or products must be in the original packaging and the User/Buyer has not opened the packaging of the product;

9.8.2. the goods are not damaged;

9.8.3. the product has not been used, the consignment box has been preserved, it has not lost its commercial appearance (preserved original labels affixed to clothing, security films, etc.); this does not correspond to the goods that already been damaged during delivery, for which the User-Buyer has objected in written form up on receipt);

9.8.4. the returned goods must be in the same condition as when they were received;

 

9.9. SiKey LLC has the right to refuse to take back the product if the deadlines for returning the product were not met.

 

9.10. The User/buyer is responsible for maintaining the quality and safety of the product during the period of exercising the right of withdrawal. The User/Buyer shall be liable for any decrease in the value of the goods if the goods have been used in a manner incompatible with the principle of good faith, including for purposes other than ascertaining the nature or functioning of the goods. The goods must be undamaged, have not lost the appearance of the goods (not removed and undamaged labels, torn protective films, etc.), and unused. The product must be returned in its original packaging, in the same set as it was received, obligatory returning the document of purchase of the product and other accessories of the product that was attached to it at the time of receipt. If the product is not fully assembled, damaged, untidy-looking or not properly packaged, SiKey LLC has the right to not accept the product, as well as to not refund the money paid by the User-Buyer for the product.

 

10. EXCHANGE OF INFORMATION

SiKey LLC communicates with User/Buyer via e-mail, postal address, or telephone number. The user can use any of the communication methods listed on SaintKey.com “Contacts” section.

 

 

 

11. LIABILITY

11.1. SiKey LLC is released from any liability in all cases when losses occur due to the fact that the User/Buyer acts contrary to the procedures specified on SaintKey.com in “Terms of Use” section.

 

11.2. In the case of damage, the guilty party compensates the other party for the direct damage.

 

11.3. SaintKey.com is not responsible for non-compliance of non-essential properties (actual size, shape or tone nuances, etc.) of the goods shown on SaintKey.com web store images with the actual properties of the goods due to the screen parameters, lighting, or any other similar external conditions of the device used by the User/ Buyer.

 

11.4. SiKey LLC shall not be liable for any delay or non-performance, or other failures, due to circumstances and obstacles beyond SiKey LLC reasonable control, including but not limited to strikes, government orders, acts of war or national emergencies, terrorist threats or acts, environmental or climate anomalies, non-compliance by third parties, disruptions to the Internet connection, and failures of computer equipment and software In the event of such force majeure, SiKey LLC will endeavour to eliminate the delays as soon as possible.

 

12. OTHER PROVISIONS

12.1. The relationship between the User/Buyer and SiKey LLC is regulated by these Terms of Use, as well as the legal acts of the Republic of Latvia.

 

12.2. In case of any questions or disagreements, the User/Buyer will contact SiKey LLC customer service by phone or e-mail. All disputes shall be settled by negotiation as far as possible. A User who is a consumer within the meaning of the Consumer Rights Protection Law (a natural person who purchases a product for a purpose not related to its economic or professional activity) has the opportunity to exercise and protect her / his legal rights under the Consumer Rights Protection Law and related regulatory enactments. If no agreement is reached, the dispute shall be submitted to a court in accordance with the legislation of the Republic of Latvia.
